Genuka Pay – Terms of Service

Article 1 – Purpose

These Terms of Service govern the access and use of the Genuka Pay platform, including any associated website, mobile application, APIs, and services provided by Genuka Pay.

By accessing or using the platform, you agree to comply with these Terms.

Article 2 – Description of Services

Genuka Pay provides a technical payment orchestration platform that enables users to initiate and manage financial transactions through licensed third-party payment service providers.

Role and Positioning:

Genuka Pay is a technical payment facilitator/orchestrator
Genuka Pay does not operate as a bank, financial institution, or electronic money issuer
Genuka Pay does not hold or store customer funds at any time

Fund Processing:

All payment processing and fund settlement are exclusively handled by licensed financial partners and payment providers (Orange Money, MTN Mobile Money, etc.)
Funds flow directly between customer accounts and licensed payment provider accounts
Genuka Pay only facilitates the technical connection between the various parties

Important Clarification

Genuka Pay is a technology platform that connects merchants to payment operators but does not directly process funds.

Article 3 – Eligibility

To use Genuka Pay services, users must:

be at least 18 years old
provide accurate and complete information
comply with applicable financial regulations
not be subject to financial sanctions or restrictions

Genuka Pay reserves the right to refuse service if eligibility requirements are not met.

Article 4 – Account Registration

Users must create an account to access certain services.

During registration, users may be required to provide:

full name
phone number
email address
verification codes
identity documents where required

Identity verification may be requested to comply with Anti-Money Laundering (AML) and Know Your Customer (KYC) obligations.

Article 5 – Use of the Platform

Users agree to use Genuka Pay only for lawful purposes.

The following activities are strictly prohibited:

money laundering
fraud or financial manipulation
terrorist financing
identity theft
unauthorized commercial activities

Warning

Genuka Pay may suspend accounts suspected of illegal activity.

Article 6 – Transaction Processing

Transactions initiated through Genuka Pay are processed by licensed third-party payment service providers.

Genuka Pay acts solely as a technology intermediary facilitating access to these services.

Genuka Pay cannot guarantee uninterrupted transaction processing due to possible disruptions from telecom operators, banking systems, or payment providers.

Article 7 – Fees

Certain services may involve transaction fees.

All applicable fees will be displayed to the user prior to confirming the transaction.

Article 8 – Security Responsibilities

Users are responsible for safeguarding their account credentials, passwords, and authentication codes.

Genuka Pay implements technical and organizational security measures to protect its systems, but users acknowledge that no digital system can be completely secure.

Article 9 – Suspension and Termination

Genuka Pay reserves the right to suspend or terminate user accounts in cases including but not limited to:

violation of these Terms
suspected fraud or illegal activity
regulatory compliance requirements
security risks

Article 10 – Limitation of Liability

Genuka Pay shall not be liable for damages resulting from:

service interruptions
third-party payment provider failures
telecommunications outages
unauthorized access caused by user negligence
